Terms and conditions of use of the website www.rofert.ro
1. Definitions
In this document, the following capitalized terms will have, unless the context indicates otherwise, the meanings specified below:
REGISTERED TRADEMARKS: represent the registered trademarks of ROFERT ROMANIA S.R.L., such as, but not limited to, the name ROFERT.
SITE: represents the Internet SITE belonging to ROFERT, located at the address www.rofert.ro, through which the USER has access to information on the services and products offered / provided by ROFERT in the network of ROFERT stores.
ROFERT: represents the company ROFERT ROMANIA S.R.L., with headquarters in STR. CALEA BUCHAREST NO. 40, POSTAL CODE 927193, PALTINIȘU VILLAGE, COM. PERIEȚI, COUNTY. IALOMIŢA
USER: represents the person who accesses the SITE, for private or professional purposes and who has accepted the TERMS AND CONDITIONS of this SITE, fulfilling in this sense all the requirements of the registration process, or a visitor to the site who is not registered/logged in.
ABUSIVE USE: represents the use of the SITE in a way contrary to the practice in the field, the regulations and the legislation in force or in any other way that may cause damage to ROFERT.
2. Site Content
2.1. The information published on the SITE is information of general interest about ROFERT, the products sold by it, information about its partners as well as other information considered by ROFERT to be of interest to USERS.
2.2. The information is usually made available to USERS, free of charge. ROFERT reserves the right to implement certain services on the SITE that will be offered for a fee to USERS.
2.3. ROFERT is the holder of all intellectual property rights over the SITE, respectively over its design and content, as well as over all Trademarks registered by ROFERT and published on the SITE.
The USER has the obligation to respect all the intellectual property rights of ROFERT, provided by the legislation in force.
3. Use of the Site
3.1. The USER undertakes to access and use the SITE for purposes and by means that do not constitute abusive use.
4. Limitation of liability ROFERT ROMANIA S.R.L
4.1. Responsibility for the content of the SITE.
ROFERT is not and cannot be held responsible for damages caused by errors, inaccuracies or non-updating of the information published or maintained on the SITE, which are not due to its fault. USERS can find detailed information in the ROFERT store network.
4.2. If the prices or other details related to the products/promotions were displayed incorrectly, including due to the fact that they were entered incorrectly in the database, we reserve the right to cancel the delivery of the respective product and notify the customer by phone/e- email as soon as possible about the error, if the product has not been delivered yet.
4.3. The characteristics of the products presented on the SITE are taken over / made available by manufacturers and / suppliers and ROFERT does not assume responsibility for the correctness of this information.
4.4. The prices of the products on this SITE are informative and may undergo unannounced changes. The promotions presented on the SITE are valid during the mentioned time period.
If a period of time is not mentioned, they are valid within the limits of available stocks. The prices displayed on the SITE are not identical to those in the ROFERT store network, so there may be differences between the price of the product displayed on the SITE and that displayed in the ROFERT store network.
Orders whose products ordered on the SITE have a lower price than that displayed in the ROFERT stores, remain valid and will be honored in the order of their registration on the SITE and according to the available stock limit for each product in the order. All products presented on this SITE are available within the limit of available physical stock. In the case of stock exhaustion, the order will be cancelled, and the customer will be notified in this regard by the ROFERT representative. For paid orders, the counter value will be returned to the account from which the payment was made.
4.5. Also, the images are presented on the SITE as an example, and the delivered products may differ from the images in any way due to changes in characteristics or design, without prior notification by the manufacturers.
4.6. A pre-order product is a product that is to be launched and can be purchased before launch. The provider reserves the right to change the release date without notice. Pre-order products are added to the basket in the same way as any other product in the online store. By pre-ordering, you ensure that you will receive the product immediately after launch and that you will benefit from a very good price. Pre-ordered products will be delivered within an estimated period of 1-3 working days from the launch, but no later than 15 days, if the product is in the ROFERT stock on the day of the launch. If the product comes into ROFERT's possession after the launch date, the delivery will be made in 1-3 working days from the moment the product enters the ROFERT stock, but no later than 15 days. Pre-orders are paid in the same way as a normal order, through any of the accepted payment methods. In any of the situations (payment on delivery or online payment) it is necessary to wait for confirmation by phone or email from an operator, when the product becomes available. You can cancel a pre-order at any time. If the latter has already been paid, you can choose to return the amount or credit your account in order to place another order.
Note – any unauthorized intervention leads implicitly to the loss of the product warranty!
4.7. ROFERT reserves the right to complete and modify any information on the SITE.
4.8. Any problem caused by the products and/or services presented on the SITE will be resolved amicably within 15 working days from the date of written notification of the problems by the USER.
5. Additional Losses/Costs.
ROFERT is not responsible for any losses, costs, lawsuits, claims, expenses or other liabilities, if these are directly caused by non-compliance with the Terms and Conditions.
5.1. ROFERT is not responsible for damages caused as a result of the Site not functioning as well as for those resulting from the impossibility of accessing certain links published on the Site.
5.2. ROFERT is not responsible for technical failures of the network/equipment belonging to mobile phone operators/payment processors, etc.
6. Use of the Internet Browser. ROFERT guarantees the optimal use of the Site by minimally using Internet Explorer 6.
6.1. We inform you that any complaints regarding the aesthetic defects of the products will be taken into account and will be analyzed only if they are complained about within the first 48 hours from the moment of receipt of the product.
6.2. The payment methods for completing an online order are: cash on delivery, online by bank card, payment order.
- If you opt for online payment with a bank card, we inform you that the registration of the payment does not guarantee the confirmation and delivery of the order. If the order is not confirmed (the term for processing the order is 48 hours) the amount of money paid will be returned to your account as soon as possible.
6.3. Registering the order does not represent its confirmation. After receiving the order, it will be processed by our operators in order to confirm and establish the delivery details. The estimated delivery time is 1-3 working days from order confirmation, but no later than 15 days.
6.4. During Easter, winter holidays, the Black Friday event, as well as during other company campaigns, the processing of an order and its delivery can take between 7-10 working days, but no more than 15 working days.
6.5. Delivery. The buyer has the right not to accept the delivered goods if they do not comply with the technical details specified on the product page. In this case, ROFERT assumes the responsibility of bringing the products into compliance.
6.6. The buyer will take ownership of the goods after signing the transport document and making the payment (if it was not previously made) to the courier.
6.7. In case of cancellation of the order, none of the involved parties will claim/request damages.
6.8. Return of products: According to GEO no. 34/2014, the buyer has the possibility to withdraw from the distance contract within 14 days starting from the day he takes physical possession of the product.
You have the possibility to return the product within this term, it is not mandatory that it be returned in the original packaging. For this, you can fill out the return form available in the Return form section or you can communicate your intention (unequivocal declaration) of return in any other way (in writing - postal envelope, by e-mail, by phone, etc.).
In the return process, you can use any shipping service.
7. Accessing the SITE www.rofert.ro
This implies the USERS' acceptance that their personal data will be kept and processed by the ROFERT company. The information you send us is treated with the utmost confidentiality and exclusively for the purposes for which it was collected.
The purposes of processing this data are: creating a user account for purchasing products, delivering ordered products, subscribing to our offers (user consent), sending commercial communications (user consent), sending offers for complementary products or accessories to purchased products (based on the consent of the user and based on the legitimate interest of the company ROFERT ROMANIA or the companies in the group), informing the subscribed users about the promotions of the ROFERT store network or about any other promotions or activities carried out by ROFERT ROMANIA through any means of communication (mail, e-mail, telephone , SMS, etc.), the creation of a database for the creation of statistical reports, the transmission of communications regarding the amounts donated in fundraising campaigns to which ROFERT ROMANIA is a party, etc.
At the time of contact, the user will be informed about the purpose of the action for which he was contacted and his consent will be requested, if the said action involves the processing of his personal data and for this his consent is needed.
ROFERT ROMANIA S.R.L. is the sole owner of the information collected from this site. ROFERT ROMANIA S.R.L. undertakes that personal data will not be disseminated to third parties through sale, partial disclosure or rental.
ROFERT ROMANIA SRL may disclose your personal information to group companies or authorized third parties, with whom the company has concluded various contracts, all of which are validated by the Legal Department and followed by confidentiality agreements (Non-Disclosure Agreement) and/or personal data processing agreements (DPA).
ROFERT ROMANIA can conclude partnership agreements with various commercial companies or private non-profit legal entities that organize or participate in humanitarian/philanthropic campaigns.
If the partnership involves the transfer of information and data about users, the partner will be obliged to respect the confidentiality of this data and to use it exclusively for the purpose of executing the respective contract. Partners can have the capacity of Operator-Person authorized to process personal data or they can be associated Operators, jointly establishing the purposes and means of data processing; in both cases, your data will be processed in accordance with the provisions of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
If you select the option to pay online by paying with a bank card, ROFERT will send to the payment processor only data related to your order, without accessing and processing other data related to the bank card.
Our partners offer complementary products and services to those purchased from ROFERT stores and from www.rofert.ro; on the basis of these partnerships, the interaction with you, the exercise of the option to subscribe to the Newsletter, you may be contacted by representatives of: a subcontracted carrier in case you have opted for the delivery of the order by courier, your data may also be accessed by the companies that provides (email) marketing services, advertising agencies, direct marketing operators who carry out various specific actions approved by ROFERT, landline or mobile phone operators.
Any processing of your personal data will be done in compliance with the Personal Data Protection Policy.
8. Data collection
It is done through various methods and specific tools such as: professional traffic tracking software, the newsletter management application, by saving in databases the various contact forms available on the site that are filled in by users, by online questionnaires, etc. .
We use IP addresses to analyze browsing habits, administer the site, track user interests and gather demographic information for internal use. All this aims to increase the degree of ease in using the site and to publish information as relevant as possible to the interests of users.
9. Restricted access and (un)subscription
By accessing the site, creating a user account and placing orders, the user expressly accepts the terms and conditions of the site, the way of carrying out online operations as described on the site.
There are areas on the site that require registration (see Registration) or subscription (see Newsletter).
In the case of the newsletter, each edition/alert also contains the way to unsubscribe; once this option is accessed, the unsubscription is applied immediately, no further confirmations are required from the users. Depending on the type of operation (website account creation, newsletter subscription), the user may be asked for data such as: name, surname, email, address, phone number, CNP, company, etc.
Some requested data are mandatory in order to be able to provide the good or service that the customer is interested in or to be able to retain/collect the amount donated by you.
These data are used to identify, validate or complete the subscriber account, to evaluate the data entered in the online credit form.
Personal data will be used for the purpose of carrying out contracts and processing your orders. Afterwards, the data will be saved taking into account the retention periods according to fiscal and commercial legislation and as long as necessary to protect the rights of ROFERT ROMANIA.
For the smooth running of the sales contract, after the customer has expressed his agreement, ROFERT can contact the customer by phone or email if he provides identification and contact data while accessing the website. At the time of placing the order, the customer agrees with the subsequent form of communication (telephone or electronic) and with the seller's mode of operation.
If you have entered your contact data, but have not validated the user account, you can be contacted by a ROFERT representative to complete this procedure by deleting the data if you no longer wish to become a user or by providing assistance and validating the account. This action is based on our legitimate interest in cleaning and updating the database.
If you have added products to the Shopping Cart, but have not completed the order, you can be contacted by email or phone by a ROFERT representative, in which you will be notified of the fact that you have forgotten the products in the cart. This unique action is justified by the company's interest in clarifying the situation by concluding the sales contract or canceling it. After this action, the client will be contacted if he has expressed his consent to receive other commercial offers/communications.
Within a reasonable period after the purchase of a good or service (usually after 14 days in which the customer can return the product, withdrawing from the sales contract) the buyer can be contacted through the same communication channels agreed upon when the order was placed, for the transmission of a feedback/review related to the purchased good or service. Thus, the client is actively involved in creating new services and detailing the characteristics of the goods and informing other potential buyers on the site. Your opinions are carefully analyzed by ROFERT employees who use them as a guide in choosing the products and range offered to customers.
In the case of the "Recommend a friend" application, the name and e-mail address of the friend to whom you want to recommend a ROFERT product/newsletter will be requested. The application will automatically send your friend an email inviting him to visit the site.
ROFERT stores this information for the sole purpose of sending this unique email message. No further alerts/information will be sent to the friend's address without his prior consent.
10. Cookies
The website www.rofert.ro uses cookies, which are data stored on the user's computer, mobile terminal or other device, containing information about it. The use of the cookie mechanism is an advantage for the visitors, it allows memorizing some navigation options on the site such as the language in which the site is displayed, the type of filters that are applied when displaying certain pages, memorizing the username and password for quick access to site content. 12. Bonus Card loyalty program
For participating in this program, ROFERT ROMANIA S.R.L will process your data for the purposes presented in the program regulations and in compliance with the provisions of the legislation on the processing of personal data. For subsequent marketing communications and product offers, ROFERT ROMANIA S.R.L will request your express consent and offer you the possibility of refusing such processing, without affecting your possibility to participate in the loyalty program.
13. Notifications and actions regarding user information
At the users' written request, dated and signed, sent to the ROFERT address, he undertakes:
1. a) to confirm to the applicants, whether or not they process personal data; this is done free of charge, only once a year;
2. b) to rectify, update, block, delete or transform into anonymous data, free of charge, the data whose processing does not comply with the provisions on the protection of individuals regarding the processing of personal data and the free movement of such data;
3. c) to transmit to the user the personal data concerning him and which were provided by ROFERT ROMANIA S.R.L. in a structured format, currently used and which can be read automatically in order to transmit them to another operator;
4. d) to stop processing the user's personal data, if he requests it.
14. Communication of changes
If a user's identification information changes (such as postal code) or if a user wishes to opt out of our services, we will take care to correct, update or delete the personal data that the user has entrusted to us. - The displayed promotions will be valid for limited periods of time, specified on the product presentation page of the online store / Special Regulations and within the limits of available stocks.
